Our aim at Kilkeel Physiotherapy Clinic is to deliver a professional, caring and evidence based service to our patients. Our Terms and Conditions are there to help you understand how we operate our practice. Do not hesitate to ask if there is anything you wish to ask, or further discuss in relation to our services.
By commencing treatment, you are deemed to have acknowledged and have agreed to be bound by these Terms & Conditions.
1. The Agreement
This agreement is between the patient (referred to as “you,” “your” and “client”) and
Kilkeel Physiotherapy Clinic (referred to as “Kilkeel Physiotherapy Clinic,” “we” or
“us”). Where a person as a parent, guardian or attorney arranges treatment on behalf of another under their care, they agree that they will be bound by these Terms. In these circumstances, the references in these Terms to “you” and “your” shall include, as well as the patient, the parent, guardian or attorney.
Please read these terms carefully. They provide the basis on which you will be provided goods and services by Kilkeel Physiotherapy Clinic, its staff, contractors, and service providers.
Kilkeel Physiotherapy Clinic may update these terms from time to time and you will be
notified of any changes that come into effect via one of the following methods:
· In person
· Via notifications on our website
· Via notifications within the clinic
· Via email to the address that we hold for you (it is your responsibility to ensure that the address we hold for you is correct).
Terms & Conditions will not be posted to you unless this is specifically requested in writing.
2. Rates & Payment
Our current and standard physiotherapy and class rates can be found out by contacting us.
2.1. Self-Payment
Payment for our Physiotherapy Services is due at the time, or on the day of treatment. We accept cash and card payments. Bank transfer (BACS) is available on request. Payment always remains your responsibility and where possible you will receive an invoice reminder in the event of non-payment during the course of treatment.
2.2. Health Insurance
Cover Kilkeel Physiotherapy Clinic is a registered provider for health insurance companies as advised by multiple insurance companies.
3. Non-attendance and Cancellation
We reserve the right to charge a cancellation fee of 100% of the treatment cost if you fail to attend an appointment without giving prior notice. In the case of cancellation within 24 hours of an appointment, we reserve the right to charge 50% of the treatment cost; this charge will be waived if we are able to re-book the appointment slot. Please note that insurance companies may not pay these cancellation charges and you will therefore be invoiced directly.
3.1. Expiry of Purchases
The expiry date of each class package is clearly detailed on the website and the start date is the day of purchase.
3.2. If we cancel your booking
If we cancel a class or classes that you have booked, we will contact you directly by telephone or email and offer you the choice of:
· Having the class returned to your package; or
· Being transferred to a class at an alternative date and time
If we cancel any of your physiotherapy sessions, we will contact you via telephone or email and offer you the choice of:
· Another appointment
· Full refund (only if cancelled with less than 24 hours’ notice)
4. Administrative & Additional Charges
We reserve the right to charge for any additional administrative time other than that which would reasonably be required to fulfil your appointment booking and payment and to communicate with your GP or medical consultant. Such administrative examples include clinical reports or copies of clinical records, handling of rejected or late payment fees.
5. Discharge Reports
Please inform us if you wish for a discharge summary from your Clinician.
6. Confidentiality & access to medical records
Kilkeel Physiotherapy Clinic is committed to maintaining strict confidentiality and protecting your personal information. Please refer to Privacy page on our website for full details on what information we store, how we store it and why. We agree to provide access to your medical records on receipt of a signed and dated medical access request under the Data Protection Act.
7. Contact Details
It is important that you keep us updated of any changes in your contact details. We cannot be held liable should you fail to update us regarding any changes to your contact details including name, mailing address, telephone numbers or email address.
8. Your Property
Clinic areas can be busy environments. Whilst we will take all reasonable care to ensure the safety of your belongings, Kilkeel Physiotherapy Clinic does not accept any responsibility for the theft or loss of, or damage to, any of your or your visitor’s property.
9. Offers & Promotions
Discounted, promotional and early-bird offers must be paid for in advance and cannot be cancelled, are non-transferable and non refundable. Discounted offers cannot be used in conjunction with any other offer or discounted package and may be for specific dates/times only. Please also note that discounts are not applicable to patients using medical insurance as a means of payment.

External links are clickable to other websites. Although this website only looks to include professional, quality, safe and relevant external links, users are advised to adopt a policy of caution before clicking any external web links mentioned throughout this website.
11. Social Media
Communication, engagement, and actions taken through external social media platforms that this website and its owners participate on are custom to the terms and conditions as well as the privacy policies held with each social media platform respectively.
Users are advised to use social media platforms wisely and communicate / engage upon them with due care and caution regarding their own privacy and personal details.
12. Information & Materials
Neither we nor any third parties provide any warranty or guarantee as to the accuracy,
timelines, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law. Your use of any information or materials on this website is entirely your own risk, for which we shall
not be liable. It shall be your own responsibility to ensure that any products, services, or information available through this website meet your specific requirements. This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance, and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these T&Cs. Unauthorised use of this website may give rise to a claim for damages and/or be a criminal offence.
13. COVID Procedures
If you are feeling unwell or are showing symptoms of COVID-19 please cancel your
appointment immediately and let us know.
If you arrive with noticeable symptoms, you will be refused entry and asked to leave.
If you have been unwell, please allow 5 days with no symptoms before returning to the clinic and confirm clearance from COVID-19 before returning.
If you become symptomatic whilst at the clinic, you must leave the venue immediately and if safe to do so, without touching anything or coming into contact with anyone else.
If you become unwell having left the clinic, you must contact us immediately on 073 0127 3549 so we can follow our inhouse tracing procedure.
Please do not bring food or personal belongings to the clinic other than your water bottle and small bag.
Please follow the teachers instructions with cleaning procedures for Pilates classes and when entering and moving around the clinic.
If you do need to cancel any of your sessions/Pilates classes due to COVID-19, we will reschedule your appointment or, if it was a Pilates class, send you through a video so you can make up your class when
you are well enough to do so.
14. Online Classes
If you are unsure as to what type of class would be suitable for you please contact your instructor.
Please note our online group classes are not suitable for anyone who has not been signed off by a medical professional following injury, or health issues which may affect your ability to exercise.
Kilkeel Physiotherapy Clinic will not be held responsible for any injury following our online sessions. Individuals are responsible for themselves and need to skip or modify exercises as necessary. These will be given by your teacher during class.
It is your responsibility to notify the teacher of any changes to health before taking part in a class.
You need to complete a health questionnaire before taking part in class. Classes are taken
at your own risk.
Payments are collected monthly through subscription and can be cancelled at any time. Refunds will not be used for any monthly pass that has been cancelled halfway through an agreed month. You can cancel your subscription in your account online or by contacting the clinic directly. Please ensure you have enough space to move safely, so that nothing will obstruct your movement. We do not take responsibility for your internet connection should it go down before or during classes.
Your class link will be sent to you an hour before the start, it is your responsibility to save
this to enable you to join the class. If you have not received the link, you must ensure that
you have communicated this to the teacher at least 15 mins before the start so it does not
interrupt the class. Please log in 5 minutes before the class begins.
Links will be emailed to you; these may be password protected and should not be shared with anyone else. This helps to protect the business and teacher privacy.
15. Face to Face Classes
If you do not attend the class or classes you have booked, and you do not notify us 3 hours or more before such class or classes of your non-attendance, you shall not be entitled to a refund. You may cancel your booking at any time without charge if you do so 12 hours or more before the date and time of the class you have booked. Please notify your instructor if you are not attending class.
Please wear fitted clothing that you can move comfortably in and clean socks. It is best to tie long hair back and not wear jewellery.
Group classes will normally, though not always, be taught by a named instructor. Kilkeel
Physiotherapy Clinic reserves the right to substitute instructors as needed.
Class lengths may vary between 40-60 minutes in length.
16. Force Majeure
We shall not be liable to you or deemed to be in breach of these Terms by reason of any delay in performing or any failure to perform any of our obligations in relation to these Terms, if the delay or failure was due to any cause beyond our reasonable control, including, but not limited to , Acts of God, explosion, flood, tempest, fire or accident, war or threat of war, riot, sabotage, insurrection, civil disturbance, restrictions, regulations, by-laws, prohibitions or measures of any kind on the part of any government, parliamentary, or local authority, strikes, lockouts or other industrial action or trade disputes (whether involving our employees or those of any third party), I.T. viruses, difficulties in obtaining raw materials, labour, fuel, parts or machinery, power failure or breakdown in machinery.
17. Waiver
No delay or failure by either party to exercise any of its powers, rights or remedies under these Terms will operate as a waiver of them, nor will any single or partial exercise of any such powers, rights or remedies preclude any other or further exercise of them. Any waiver to be effective must be in writing.
18. Severability
If any part of these Terms is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful, or unenforceable then such part will be severed from these Terms, the remainder of which will continue to be valid and enforceable to the fullest extent permitted by law.
19. Entire Agreement
These Terms together with our order confirmation constitute the entire agreement between the parties and shall have effect to the exclusion of any other memorandum, agreement, or understanding of any kind, whether oral or written, between the parties hereto and touching concerning their subject matter.
20. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with Irish Law and the parties hereby agree to submit to the exclusive jurisdiction of the Irish Courts.
21. Complaints Procedure
